Same Wavelength uses small clips of music for educational purposes to illustrate and highlight certain songs and topics that are discussed throughout the conversations. The use of this material helps to bring new context to both the artist’s work and the issues being discussed, thereby making the conversations and the series transformative in nature. Audio clip excerpts are used for the purpose of education, discovery, and new understanding. We believe this use, in every instance, to be protected under Fair Use.
Under Section 107 of the Copyright Act 1976, “the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching, scholarship, or research, is not an infringement of copyright.”
Every effort has been made to receive licensing for the content used in the series by contacting the artists’ management, labels, and publishers directly. No songs or other forms of copyrighted content are used in their entirety. All content is cited in the show notes for each episode, and listeners are strongly urged to support the artists and their work.
